High Court issues notice to UGC, HRD Ministry on NET/ JRF criteria

The University Grant Commission's action of changing the eligibility criteria for the NET/JRF examinations post the examination held in June 2012, has been challenged before the High Court of Bombay. Justice Bhushan Gavai and Justice Prasanna Varale, issued notice to the respondents Union Human Resources Development Secretary and the Chairman, University Grants Commission to show cause in reply to the petition by October 31 next. The court has also asked the respondents to preserve the OMR sheets of these petitioners.

According to the petitioners, as the authorities have not declared eligibility criteria for the NET examination well in advance before the said examination, this action on their part is illegal and unjustified. The petitioners have claimed that as they have not been declared successful, though they have secured more than minimum percent of marks in all three papers, this action on the part of the respondents is mala fide, arbitrary and that demonstrates colourable exercise of powers.

Advocate Prashant P. Thakare appeared for the petitioners.
